Is It Illegal to Make a Meme of Someone?
When making a meme of another person is fine, and when it can cross into copyright, privacy, defamation or harassment. A plain-English overview, not legal advice.
This is general information, not legal advice. Laws differ a lot between countries and US states. If you're worried about a specific meme, ask a lawyer where you live.
Most memes of real people never cause a problem. A few do, and they tend to fall into the same handful of categories. Here's what to watch for.
1. The photo belongs to someone
Whoever took a photo usually owns its copyright, not the person in it. Using a photo from a news site, a photographer's portfolio or a stock library without permission can be infringement, even if the joke is yours. Many countries allow some use for commentary, criticism or parody, such as fair use in the US, but where that line falls depends on the details.
2. It says something false and damaging
A meme that presents a made-up claim as fact, such as implying someone committed a crime, can be defamation. Obvious jokes and opinions are treated differently from statements people would take literally.
3. It uses their face to sell something
Many places protect a person's right to control commercial use of their name and likeness, often called the right of publicity. A meme in a group chat is one thing. The same meme in an ad, on merchandise or in a brand's posts is another.
4. It's part of harassment
Repeatedly targeting someone, especially a private person or a minor, can cross into harassment or bullying, which is illegal in many places and against every major platform's rules. Sexualized or humiliating edits of real people are treated especially seriously, and some places have laws specifically about AI-generated fakes.
5. Platform rules are stricter than the law
Even when something is legal, apps and social networks can remove it or suspend your account. Most ban content that targets private individuals or uses someone's likeness in misleading ways.
The safe version
- Make memes of yourself, or of friends who are in on it.
- Use photos you took, or ones you have permission to use.
- Keep jokes clearly jokes.
- Don't use anyone's face to promote something without their written OK.

Common questions
Is it illegal to make a meme of someone?
Usually not, for a joke shared with friends. It can become a legal problem if it uses someone else's photo without permission, makes false claims that harm their reputation, uses their face to sell something, or is part of harassment. Laws differ by country and state.
Can I make a meme of a friend?
Legally it's usually fine for a private joke, but ask first. Something funny in the group chat can feel very different once it spreads.
Can I use a celebrity's photo in a meme?
Commentary and parody are often allowed, but the photo itself is usually owned by a photographer or agency, and using a famous face to promote a product can break publicity laws.
