Terms of Use

These terms are an agreement between you and Sparkly, LLC ("we"), which makes MemeYou. By using MemeYou, you agree to them. If you don't agree, don't use the app.

Who can use MemeYou

You must be 18 or older.

Using MemeYou

The MemeYou iPhone app is licensed to you under Apple's Licensed Application End User License Agreement (Standard EULA). These terms also apply to your use of MemeYou.

Your photos

Only upload a photo of yourself, or of your own pet. You confirm that you have the right to use each photo you upload. Don't upload a photo of anyone else, whatever their age, even if they say it's fine.

AI processing of your photos

The screen where you add a photo names OpenAI. By adding a photo, you agree that each photo you upload is sent to our server and to OpenAI to make your GIFs. We don't store your photo on our server. Read the Privacy Policy for details.

What you can't do

Don't use MemeYou with sexual content, with any content involving minors, to impersonate or deceive anyone, to harass or harm anyone, or to break the law or someone else's rights. Don't present a GIF as a real recording of something that happened. Don't try to bypass usage limits or moderation, attack the service or reverse engineer the app, except where the law allows it. We may limit or block use that breaks these terms.

Your content and generated GIFs

You keep ownership of the photos you submit. You give us a limited, worldwide, non-exclusive, royalty-free license to process them, and to have our service providers process them, only to provide and protect MemeYou, as described in the Privacy Policy. This license ends when the content is deleted.

As between you and us, we assign to you any rights we have in the GIFs generated for you, and you may use them for personal purposes, including in chats and as stickers. We don't keep your GIFs on our server, so save the ones you want to keep.

AI results

GIFs are generated by AI. They may not look like you or your pet, and they may contain errors or odd details. You're responsible for how you share your GIFs.

MemeYou may not always be available. Limits apply, including limits per device and a daily cap on the whole service. Packs and reactions may change.

Free GIF, packs and subscriptions

New devices get one free GIF, usable on the motions we mark as eligible. One pack credit unlocks one pack, with 12 GIFs plus 2 retries. A generation is only counted when it succeeds.

Apple handles payment, and prices are shown in the app before you buy. One Pack is a one-time purchase. The weekly plan renews automatically and adds 2 pack credits each billing period, until canceled in your Apple Account settings at least 24 hours before the end of the period. Refunds are handled by Apple.

Your purchases are tied to your device and Apple Account. Your GIFs are only on your iPhone, so if you delete them or lose your device, we can't recover them.

Disclaimers and liability

MemeYou is provided "as is", without warranties, to the fullest extent the law allows. If MemeYou fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the fullest extent the law allows, Apple has no other warranty obligation. To the fullest extent the law allows, we aren't liable for indirect or consequential damages, and our total liability is limited to the amount you paid for MemeYou in the prior 12 months. Nothing here limits rights you have under law that can't be limited.

Apple

These terms are between you and Sparkly, LLC, not Apple. We, not Apple, are responsible for MemeYou, its maintenance and support, and any product or legal claims about it, including claims that it infringes someone's intellectual property. You confirm that you aren't in a country subject to a U.S. embargo or on a U.S. list of prohibited parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Governing law

Applicable law determines which laws govern these terms and which courts can hear a dispute. These terms do not limit consumer protections or access to courts that applicable law gives you. Before bringing a claim, please email support@memeyou.app so we can try to resolve the issue.

Changes

We may update these terms, and we'll update the date above when we do. If changes are significant, we'll tell you in the app before they apply. Continuing to use MemeYou after that means you accept the updated terms.
